Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Dreamscape mobile application ("App") available on iOS and Android, provided by GestaltMind LLC ("we", "us", or "our").

1. Acceptance of Terms

Guest Mode

Dreamscape offers a Guest Mode that allows you to use basic journaling features entirely offline without creating an account. In Guest Mode:

All data is stored locally on your device only
No authentication or account creation required
No data transmitted to our servers
AI-powered features are unavailable
These Terms do not apply to Guest Mode usage

You may use Guest Mode without accepting these Terms. However, we recommend reviewing our medical disclaimer (Section 10) for your own awareness.

Account Mode

To access AI-powered features, you must create an account and accept these Terms. By creating an account or using AI features, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may continue using Guest Mode or discontinue using the App.

2. Eligibility

You must be at least 13 years old to use Dreamscape. By using the App, you represent that you meet this age requirement. If you are under 18, you should have parental or guardian consent to use the App.

The App is available on iOS (via the App Store) and Android (via Google Play Store). You must comply with the respective platform's terms of service.

3. Account Registration (Account Mode Only)

This section applies only if you choose to create an account for AI-powered features. Guest Mode does not require account registration.

To use AI-powered features in Dreamscape, you must create an account. Authentication uses one-time passwords (OTP) sent to your email or phone via SMS - we do not store passwords. You agree to:

Provide a valid email address or phone number for authentication
Keep your email/phone account secure and confidential
Notify us immediately of any unauthorized access to your account
Accept responsibility for all activities that occur under your account
Not abuse or share access to AI features, which use our API credits

Account Purpose: Accounts exist primarily to protect our AI service costs from abuse. Basic journaling features work offline without an account.

SMS Consent for Authentication

If you choose SMS authentication, you expressly consent to receive text messages containing one-time passwords (OTPs) from Dreamscape via Twilio at the phone number you provide. You understand that:

Messages are sent only for authentication purposes (OTP codes)
Message frequency varies based on your login activity
Standard message and data rates may apply from your carrier
Consent is not a condition of using Dreamscape - email authentication is available as an alternative
You can opt out at any time by replying STOP to any message, or by switching to email authentication in your account settings
SMS delivery may be affected by your carrier and is not guaranteed

4. License and Usage Rights

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Dreamscape for your personal, non-commercial purposes. You may not:

Copy, modify, or create derivative works of the App
Reverse engineer, decompile, or disassemble the App
Rent, lease, sell, or sublicense the App
Remove or alter any copyright, trademark, or proprietary notices
Use the App for any illegal or unauthorized purpose
Interfere with or disrupt the App's functionality or servers

5. User Content and Data Storage

Local Storage

You retain complete ownership of all content you create in Dreamscape, including dream entries, recordings, drawings, and notes ("User Content"). All User Content is stored locally on your device only. We do not have access to, store, or back up your dream journal content on our servers.

AI Feature Usage

When you use AI-powered features (such as dream analysis or voice transcription):

Your content is temporarily sent to third-party AI services for processing
Dream analysis content is sent to Anthropic's Claude API
Voice recordings are sent to OpenAI's Whisper API for speech-to-text transcription
We do not store or log your content on our servers
AI responses and transcriptions are returned directly to your device
You control what content you share with AI features

Your Responsibilities

Since your data is stored locally on your device, you are responsible for:

Backing up your device to prevent data loss
Securing your device with appropriate locks and encryption
Not using AI features to process illegal, harmful, or abusive content

6. Data and Privacy

Your use of Dreamscape is governed by our Privacy Policy, which explains our privacy-first approach and the minimal data we collect (email/phone number and usage metrics only). By using SMS authentication, you consent to receiving text messages from Twilio for verification purposes.

7. Intellectual Property

Dreamscape and all related content, features, and functionality are owned by GestaltMind LLC and protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.

8. Subscription and Payments

Dreamscape may offer free and paid subscription tiers. All subscriptions are processed through the Apple App Store (iOS) or Google Play Store (Android).

Subscription Terms

Subscriptions are charged on a recurring basis (monthly or annually)
Payment is processed through your App Store or Play Store account
Subscriptions automatically renew unless cancelled before the renewal date
Pricing and billing are managed by Apple/Google according to their terms

Cancellation and Refunds

Cancel anytime through your App Store (iOS) or Play Store (Android) account settings
Cancellation takes effect at the end of the current billing period
Refund requests must be made through Apple/Google according to their refund policies
We cannot process refunds directly - contact Apple/Google support

Pricing Changes

We may change subscription pricing with advance notice. Existing subscribers will be notified before price changes take effect and can cancel if they do not wish to continue at the new price.

9. Termination

By You

You may delete your account at any time through the App settings. Upon deletion, your User Content will be permanently removed in accordance with our Privacy Policy.

By Us

We reserve the right to suspend or terminate your account if you:

Violate these Terms
Engage in fraudulent or illegal activity
Abuse or misuse the App
Fail to pay subscription fees

We will make reasonable efforts to notify you before termination, except in cases of serious violations or legal requirements.

10. Disclaimers

DREAMSCAPE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability or fitness for a particular purpose
Warranties that the App will be uninterrupted, error-free, or secure
Warranties regarding the accuracy or reliability of AI-generated content
Warranties regarding data backup or recovery (content is stored locally on your device)

Medical Disclaimer: Dreamscape is not a medical device and does not provide medical advice, diagnosis, or treatment. The App is for journaling and personal reflection purposes only. Sleep tracking and health data features are for informational purposes. AI-generated dream analysis is not professional psychological or psychiatric advice. If you have concerns about sleep disorders, mental health, or dream-related issues, consult a qualified healthcare professional.

AI Disclaimer: AI-powered features use third-party services (Anthropic Claude for analysis, OpenAI Whisper for voice transcription) and may produce inaccurate, incomplete, or inappropriate responses. Voice transcriptions may contain errors, especially with accents, background noise, or specialized terminology. We are not responsible for AI-generated content or transcription accuracy. Use AI features at your discretion.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GESTALTMIND LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of locally stored data due to device failure, uninstallation, or data corruption
Inaccurate or inappropriate AI-generated content or analysis
Service interruptions or errors in AI features
Unauthorized access to your device or account
Reliance on AI-generated content or sleep tracking data
Issues with third-party services (Supabase, Anthropic, OpenAI, Health Connect)

Data Backup: Since all dream content is stored locally on your device, we strongly recommend regular device backups. We are not responsible for data loss due to device issues, app removal, or failure to back up your device.

Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless GestaltMind LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

Your violation of these Terms
Your User Content
Your use or misuse of the App
Your violation of any third-party rights

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

Posting the updated Terms in the App
Updating the "Last Updated" date
Sending an in-app notification or email (for significant changes)

Your continued use of Dreamscape after changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the App and may delete your account.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict of law principles. Any disputes shall be resolved through:

Informal Resolution: First, contact us at support@gestaltmind.dev to attempt to resolve the issue
Binding Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration in Arizona, except where prohibited by law

You waive the right to participate in class actions or class-wide arbitration.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GestaltMind LLC regarding Dreamscape and supersede any prior agreements.
